About the course

This course aims to provide a comprehensive introduction to the most important aspects of housing management in respect to the law. It will ensure that participants understand the main legal framework, options and issues that affect housing, including the importance of following the law and internal guidelines. The course does not aim to remove the need for legal representation but will try to ensure that legal advice and subsequent action is only taken if necessary or when required as part of the process.

Course Content

Day 1

  • A brief history of housing legislation.
  • The main Housing Acts; Rent Act 1977, Housing Act 1988, Housing Act 1996, Homelessness 2001.
  • Housing status what is it and why is it important.
  • Tenancies v licenses (the differences between bare licences and contractual licences).
  • Joint tenancies.
  • Surrender.
  • Protection from Eviction act 1977- The legal framework, penalties and civil proceedings.
  • The importance of the Residents Charter.
  • Evaluation

Day 2

  • Repairing obligations (tenants and licences).
  • The obligations of both landlord and tenant. The rights and responsibilities of the Landlord and Tenant
  • Succession
  • The principle of Quiet Enjoyment.
  • Grounds for eviction.
  • Antisocial Tenants and ASBD's
  • Drug users and Section 8 amendments
  • Possession proceedings.
  • The court system.
  • Course evaluation

Learning Outcomes

At the end of the course participants will:

 

  • have knowledge of the main legal framework, options and issues that affect housing
  • understand the importance of following the law and internal guidelines
  • know the basic rules of tenancies, surrender, succession and evictions
  • understand the importance of the Residents Charter
  • state the rights, responsibilities and obligations of both landlord and tenant
  • be familiar with the court system and grounds for eviction, antisocial tenants, ASBD's, Section 8 amendments and possession proceedings.

Tony works as an independent trainer, offering a range of courses based on legal issues surrounding tenancies, housing law and housing management. He provides training for RSLs, housing Associations, local councils and voluntary organisations in the North East of England.
